I have the honour to acknowledge the receipt of your letter No. 1406 of the 27th. of March transmitting an applica- -tion from Lung Tutuh for the extradition of one Ch'en I-chuan on the charge of murder.

Extradition proceedings had already been taken against the accused on a charge of piracy. Owing to the inadequacy of the evidence brought forward in support of the charge and to the prisoner's successful establishment of an alibi the magis- -trate decided to discharge the prisoner. The Chinese Authorities have now, when the man is on the point of being released, prefer- -red a further application for his extradition on the charge of marder committed two years ago, and I would ask you to be so good as to inform Lung Tutuh that Ch'en I-chuan was discharged by the Magistrate on the piracy charge and released on the 6th. of April
and that I am unable to issue a further order to commit him on a
fresh charge of murder.
